Legal
Terms of Service
The rules for using the MOSAK Foundation platform — applying for a scholarship, giving, learning, and browsing opportunities. Written to be read, not endured.
Working draft — must be reviewed by legal counsel before launch
This Terms of Service was drafted to describe accurately what the MOSAK Foundation platform actually does. It is not legal advice and has not yet been reviewed by a qualified Ghanaian lawyer. Before the platform goes live, a legal practitioner must review this document — in particular for compliance with the Data Protection Act, 2012 (Act 843) and the requirements of the Data Protection Commission — and every placeholder below must be replaced with real, verified detail.
Placeholders to complete
- [Registered entity name — to be completed] — the exact name on the certificate of incorporation
- [Registration number — to be completed] — company / NGO registration number
- [Registered address — to be completed] — full postal address for legal notices

1.Who this agreement is with
These terms are an agreement between you and [Registered entity name — to be completed], trading as the MOSAK Foundation, a foundation registered in Ghana under number [Registration number — to be completed] with its registered office at [Registered address — to be completed] (Accra, Ghana).
They govern your use of mosakfoundation.org and everything on it: the public site, the scholarship application system, the scholar portal and learning platform, the donation flow, and the Opportunities Portal. Our Privacy Policy forms part of these terms.
2.Eligibility and acceptance
By creating an account, submitting an application, making a donation, or otherwise using the platform, you accept these terms. If you do not accept them, please do not use the platform.
- You must be at least 18 years old to hold an account, or have the consent of a parent or legal guardian: [Minimum age — to be confirmed].
- Eligibility for the Ade-Ena Scholars Program is set out on the application page and may change from cycle to cycle. Meeting the eligibility criteria does not entitle you to an award.
- If you are using the platform on behalf of an organisation — as a partner, a school, or a sponsor — you confirm you are authorised to bind that organisation to these terms.
3.Your account
- Register with accurate details and keep them current. One person, one account.
- Your login is yours alone. Keep your password secret, do not share your account, and tell us immediately at info@mosakfoundation.org if you think someone else has access to it.
- You are responsible for what happens under your account. If you let someone else use it, their actions count as yours.
- Impersonating another person, creating an account under a false identity, or registering multiple accounts to submit more than one application in a cycle will result in disqualification and closure of the accounts.
- You may close your account at any time — see section 9 of the Privacy Policy for what happens to your data when you do.
4.Scholarship applications
4.1 Everything you tell us must be true
A need-based scholarship is funded by people who gave money they could have kept. Awarding it to someone who misrepresented their circumstances takes it directly from someone who did not. So we are strict about this:
- Every statement in your application — your household income, the number of dependents you support, your grades, your CGPA, your circumstances — must be accurate and complete to the best of your knowledge.
- Every document you upload must be genuine and unaltered. Fabricated transcripts, forged letters, and doctored payslips are fraud, and we will treat them as such.
- The referees you name must be real people who know you in the capacity you describe. You must not write, edit, or arrange the writing of your own reference.
- You must tell us if your circumstances change materially between submitting your application and receiving a decision.
- We may verify anything you tell us — with your institution, your referees, or through a home or community visit — and by applying you consent to that verification.
Material misrepresentation is grounds for immediate disqualification, withdrawal of an award already made, recovery of funds already disbursed, and a permanent bar from future cycles.
4.2 Your personal statement must be your own
Write it yourself
Your personal statement must be written by you, in your own words. Getting help with spelling and grammar is fine. Having someone else write it for you is not, and submitting a personal statement generated by an AI tool may disqualify your application.
Our evaluation system includes an authenticity check on personal statements, and it is deliberately built to be fair to Ghanaian applicants: the natural features of Ghanaian English are treated as signals of authentic voice, never as faults. A flag is never an automatic rejection — it is a prompt for a human reviewer to look closely, and to ask you about it at interview. We would far rather read your honest, imperfect story than a polished essay that is not yours. Your story is the point.
4.3 Process and outcomes
- One application per applicant per cycle. If you are unsuccessful, you are welcome to apply again in a later cycle.
- Submitting an application creates no obligation on us to make an award. We fund a small number of scholars completely rather than many partially; most applicants, including excellent ones, will not be selected.
- All decisions are final, though you may ask for a human to review a decision on your application (see section 5).
- We may close, extend, pause, or change a cycle, and we may change the number of awards offered.
- MOSAK never charges an application fee, and no member of our team will ever ask you for money, a gift, or a favour in exchange for an award. If anyone asks you for payment in our name, refuse and report it to info@mosakfoundation.org.
5.Automated screening and human decisions
When you submit an application, it is scored by an automated evaluation system built on OpenAI’s GPT-4o model. That system produces a score, a written report against our criteria, and a recommendation. Section 5 of the Privacy Policy explains exactly what is sent and to whom.
The automated screen assists our reviewers; it does not replace them. No application is approved, shortlisted, or declined by AI alone. A member of the MOSAK review team reads every application and makes every final decision, and reviewers routinely override the automated recommendation in both directions. Overrides are logged with a reason.
You may ask for an explanation of a decision, and you may request a fresh human review, by writing to scholars@mosakfoundation.org within 30 days of the decision.
6.Awards and scholar obligations
If you are awarded an Ade-Ena Scholarship, the detailed terms of your award are set out in a separate scholarship agreement, which takes precedence over these terms where the two differ. In general, scholars are expected to:
- remain enrolled and in good academic standing, and tell us promptly if that changes;
- use disbursed funds for the educational purposes for which they were given;
- sign and keep the leadership pledge, and take part in the mentorship and reporting expected of the cohort;
- give us reasonable notice of a change of institution, programme, or contact details.
We may suspend or withdraw an award for material breach of the scholarship agreement, for misrepresentation in the application, or for serious misconduct. We will always tell you why and give you a chance to respond first.
Sharing a scholar’s name, photograph, or story publicly is always optional and always requires that scholar’s separate written consent. Declining costs you nothing.
7.Donations
- Donations are processed by Stripe and Paystack. You enter your card or mobile-money details directly with the provider; those details never reach MOSAK servers. Your payment is also subject to the provider’s own terms.
- Receipts. We email a receipt to the address you give at checkout once the payment succeeds. If a receipt does not arrive, contact us and we will reissue it.
- Recurring gifts. If you set up a recurring donation, it continues until you cancel it. You can cancel at any time, with no notice period and no questions asked, by emailing info@mosakfoundation.org. Cancellation stops future charges; it does not automatically refund charges already taken.
- Refunds. Donations are gifts and are generally non-refundable. We will nonetheless refund a genuine mistake — a duplicate charge, a wrong amount, an unauthorised transaction, or a gift made in error — if you tell us within [Refund window — to be confirmed]. Beyond that, refunds are at the Foundation’s discretion, and may not be possible once funds have been committed to a scholar or a project.
- Designations. We honour campaign and project designations. If a designated fund is fully subscribed, is discontinued, or receives more than the need requires, we will apply the surplus to the closest comparable purpose and account for it in our reporting.
- The donor wall. Your name appears publicly only if you asked for it to. You can ask us to remove it at any time and we will do so promptly.
- Tax. We make no representation about the tax treatment of your gift in your jurisdiction. Please take your own advice.
- You confirm that the funds you give are lawfully yours and that you are authorised to use the payment method.
8.Courses and certificates
8.1 Licence to use our course material
Courses, modules, lessons, resources, and assessments on the learning portal belong to MOSAK or to the people who licensed them to us. We grant you a personal, non-exclusive, non-transferable licence to use them for your own learning while you are enrolled. You may not copy, redistribute, resell, publish, or use our course material to train a machine-learning model without our written permission.
8.2 Your submissions
Assignments, notes, and quiz answers you submit remain yours. You grant us the licence we need to store them, mark them, give you feedback, and administer the course. Submitted work must be your own; plagiarism or AI-generated submissions passed off as your own work may void the associated certificate.
8.3 What a certificate means
Certificates verify completion, not accreditation
A MOSAK certificate confirms that you completed a particular MOSAK course and met its requirements. It carries a verification code so that anyone can check it is genuine.
It is not an accredited academic or professional qualification. MOSAK is not an accredited educational institution, our certificates carry no credit value, and no employer, university, or professional body is obliged to recognise them. Please do not describe a MOSAK certificate as a degree, diploma, or licence.
We may update, restructure, or retire a course at any time. We will try to let enrolled learners finish what they started, but we cannot guarantee that any course remains available indefinitely. Certificates already issued remain valid and verifiable.
9.The Opportunities Portal
The Opportunities Portal aggregates scholarships, grants, fellowships, internships, and similar opportunities offered by third parties, and summarises them with the help of AI so that they are quicker to scan. It exists purely as a convenience.
- These are not MOSAK opportunities. Listing an opportunity is not an endorsement of the provider, and we have no relationship with, or control over, the organisations behind them.
- Always verify with the official provider. Deadlines move, awards change, and listings go stale. Before you act on anything you read here, confirm it on the provider’s own website. Where our summary and the official source disagree, the official source is right.
- MOSAK never charges a fee for any opportunity, and neither should a legitimate provider. Treat any request for an application fee, a “processing charge”, or personal banking details as a warning sign. If you find a fraudulent listing on our portal, report it to info@mosakfoundation.org and we will remove it.
- We screen listings and remove what we can identify as fraudulent or expired, but we cannot guarantee that every listing is accurate, current, or genuine, and we accept no liability for your dealings with a third-party provider.
- Opportunity alerts are sent only if you ask for them, at the frequency you choose, and you can unsubscribe at any time.
10.Acceptable use
When using the platform, you must not:
- break the law, or use the platform to defraud, harass, threaten, defame, or endanger anyone;
- submit false information, forged documents, or another person’s work as your own;
- attempt to access accounts, applications, or administrative functions that are not yours, or probe, scan, or test the security of the platform;
- scrape, crawl, or bulk-download content, or use automated tools to submit forms, create accounts, or evade rate limits;
- upload malware, or anything obscene, hateful, or infringing;
- misuse the scholar network or messaging features to spam, solicit, or harass other members;
- impersonate MOSAK, its staff, or its founder, or solicit money in our name;
- interfere with the operation of the platform or the experience of other users.
11.Intellectual property
The MOSAK name, logo, kente motif, site design, written content, photographs, and course material are owned by MOSAK or licensed to us, and are protected by copyright and trade mark law. You may read, share links to, and quote short extracts of our public content with attribution. Anything more — reproduction, adaptation, commercial use, or use of our name or logo — needs our written permission.
Content you submit — your application, your statement, your assignments, your notes, your messages — stays yours. You grant us a non-exclusive, royalty-free licence to store, process, and use it for the purposes described in these terms and in the Privacy Policy. We will not publish your story, your name, or your photograph in our marketing or reporting without your separate written consent.
If you believe something on this platform infringes your copyright, write to info@mosakfoundation.org with details and we will investigate promptly.
12.Third-party services and links
The platform relies on third-party services — Stripe and Paystack for payments, ZeptoMail for email, OpenAI for automated evaluation and summarisation, and our hosting and database providers. Your use of those services through our platform is also governed by their terms.
We link to external sites, including opportunity providers, partners, and our social media profiles ( X, Facebook, Instagram, LinkedIn ). We do not control those sites and are not responsible for their content or their handling of your data.
13.Disclaimers
We work hard to keep the platform accurate and available, but we provide it “as is” and “as available”, and to the fullest extent permitted by Ghanaian law we exclude all implied warranties.
- We do not warrant that the platform will be uninterrupted, error-free, or free of security vulnerabilities.
- Nothing on the platform is legal, financial, medical, immigration, or career advice. Guidance in our opportunity summaries and course material is general information, not advice about your situation.
- We do not guarantee any outcome — an award, an admission, a job, a grant, or a place in any programme.
- Automated evaluation and AI-generated summaries can be wrong. We use them as tools for human beings, not as authorities, and you should treat them the same way.
- We are not responsible for third-party opportunity providers, or for any loss arising from your dealings with them.
14.Limitation of liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited.
Subject to that, and to the fullest extent permitted by Ghanaian law, we are not liable for indirect or consequential loss, loss of profit, loss of opportunity, loss of data, or loss of anticipated savings arising from your use of the platform. Our total liability to you for all claims arising out of these terms is limited to [Liability cap — to be confirmed].
This section does not limit the obligations we owe to a scholar under a signed scholarship agreement, or the rights you have under Ghana’s data protection and consumer protection laws.
15.Suspension and termination
You may stop using the platform and close your account at any time.
We may suspend or close an account, disqualify an application, or withdraw access to the learning portal if you breach these terms, if we reasonably suspect fraud or misrepresentation, or if we are required to do so by law. Except where that is impossible or unlawful, we will tell you why and give you a fair chance to respond — particularly where an application or an award is at stake.
Sections that by their nature should survive termination — the intellectual property terms, the disclaimers, the limitation of liability, and the governing law clause — continue to apply after your account closes.
16.Governing law and disputes
These terms and any dispute arising out of them are governed by the laws of the Republic of Ghana.
If something goes wrong, please write to us first at info@mosakfoundation.org. We would far rather resolve a problem in a conversation than in a courtroom, and we commit to responding within 30 days. If we cannot resolve it between us, the parties will attempt mediation before litigation, and the courts of Ghana will have jurisdiction: [Dispute forum — to be confirmed].
17.Changes to these terms
We may update these terms as the platform changes. When we do, we will update the “last updated” date on this page.
For material changes — anything that meaningfully affects your rights, your application, or your donation — we will email registered users and post a notice in the portal at least 14 days before the change takes effect. Continuing to use the platform after that date means you accept the revised terms. If you do not accept them, you may close your account.
Changes to these terms do not alter the terms of a scholarship agreement already signed, or the designation of a donation already made.
